Agreement to Terms

By downloading, installing, or using Xermes ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Application.

These Terms apply to all visitors, users, and others who access or use the Application.

Description of Service

Xermes is a mobile application that provides:

• AI-powered chat and assistant capabilities
• File management and editing tools
• Terminal and command-line access
• Task management and scheduling
• Various productivity tools and features

The Application runs primarily on your device and may connect to external services for AI capabilities and updates.

User Accounts

When you create an account with us:

• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to comply with these obligations

Acceptable Use

You agree to use Xermes only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Application in any way that violates any applicable national or international law or regulation
• Use the Application for any purpose that is unlawful or prohibited by these Terms
• Attempt to interfere with or disrupt the Application or servers or networks connected to the Application
• Attempt to reverse engineer, decompile, or disassemble any portion of the Application
• Use the Application to generate or distribute harmful, abusive, or illegal content
• Use automated systems or software to extract data from the Application
• Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity

Intellectual Property

The Application and its original content, features, and functionality are owned by Xermes and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain ownership of any content you create using the Application. By using the Application, you grant us a limited license to process your content solely for the purpose of providing the service to you.

Third-Party Services

The Application may contain links to third-party web sites or services that are not owned or controlled by Xermes. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

You acknowledge and agree that Xermes shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.

In-App Purchases

Xermes offers optional in-app purchases:

• Pro Upgrade: A one-time purchase that provides additional features and removes advertisements
• All purchases are processed through Google Play Billing
• Purchases are non-refundable except as required by applicable law
• We reserve the right to modify pricing at any time
• Existing purchases will be honored at the price paid

Advertising

The free version of Xermes displays advertisements provided by Google AdMob:

• Ads help support the development and maintenance of the Application
• You can remove ads by upgrading to the Pro version
• Ad content is provided by third-party ad networks
• We are not responsible for the content of advertisements

Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Application, to understand our practices.

Disclaimers

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT:

• The Application will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Application will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Application will meet your expectations
• Any errors in the Application will be corrected

Limitation of Liability

IN NO EVENT SHALL XERMES, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Application
• Any conduct or content of any third party on the Application
• Any content obtained from the Application
• Unauthorized access, use, or alteration of your transmissions or content

Termination

We may terminate or suspend your account and access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Application will immediately cease. If you wish to terminate your account, you may simply discontinue using the Application and delete it from your device.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Application.

Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
